Trading Terms and Conditions

1. Price and Terms of Payment

1.1 The price will be as indicated on:

(a) Invoices provided by us to customers in respect of goods supplied; or

(b) Quotation and in the absence of such a quotation in accordance with our current pricing list at the time of the order.

1.2 Verbal quotations are subject to written confirmation.

 

1.3 Written confirmation with a 50% deposit is required to secure the order and commence production.

1.4 All deliveries require invoice balance paid in full prior to dispatch.

2. Design Specification

2.1 A detailed design brief is issued following confirmation of order with a deposit. It is the customers responsibility to analyse this design brief and advise any changes within 48 hours. Not responding with changes within this timeframe confirms all is satisfactory with the design brief and Colby Furniture will proceed to manufacturing. 

 

2.2 As our products are all custom made, measurements stated are an approximate only. The construction and final measurements of each product may vary slightly depending on fabric/leather used for each design.

 

2.3 Stain colour. Please use stain samples as a guide only. Variations will occur due to the natural characteristics of timber. These colour samples may also appear slightly different depending on your screen and browser settings.

 

3. Fabrics & Leather

Fabrics and/or leather are provided by our customers. Colby Furniture is not responsible for any dye lot variations in fabrics/leather nor buyers not liking the fabric/leather choice once delivery has occurred.

 

4. Upholstered Furniture Product Care

4.1 Care instructions for your chosen fabric/s and leather can be found with fabric/s and leather supplier.

 

4.2 Colby Furniture recommends the following product care to maintain your furniture to its optimum level:

Regular vacuuming with soft brush attachments.

Protection from direct sunlight.

Professional steam cleaning.

When moving your furniture, do not drag the item along the floor.

5. Delivery and collection

5.1 We may select a carrier to deliver the goods to the address nominated by customers.

5.2 In addition to the price, customers must also pay the delivery fee. Delivery fees are dependent on location, size of package and weight.

It is the customers responsibility to ensure that the correct delivery address and contact number are provided and to inform Colby Furniture of any issues, difficulties or specific requirements associated with access for delivery.

Additional delivery fees will apply if you fail to take delivery at the nominated address.

5.3 Customers must ensure access to the premises and neither we nor the carrier will be liable for any additional costs or damage incurred because of inadequate access to the premises. Prior to delivery Colby Furniture require in writing delivery address and any access concerns i.e.- stairs, delivery dock, lift etc. We reserve the right to charge additional costs for unusual access not advised in writing.

5.4 Customers may prefer to collect the order from our warehouse or arrange a private courier to collect your order from our warehouse. The courier will need to bring a completed consignment for collection. We accept no responsibility once the products have left our warehouse.

5.5 The customers shall within 48 hours of delivery inform Colby Furniture of any concern whereby the goods are not in accordance with the order. Failing such notice, the goods and their condition shall be deemed to have been delivered and accepted by the clients.

6. Return

6.1 No cancellations, returns, refunds or exchanges will be accepted on custom made upholstered furniture.

7. Cancellation

7.1 All cancellations shall result in a cancellation fee equal to 50% of the cancelled order.

7.2 Once a custom order is confirmed, we do not allow alterations or changes or cancellation.

 

8. Product Availability

8.1 Our estimated lead time for custom made pieces depends on deposit and fabric arriving time.

 

8.2 The estimated lead-time is an approximation only and is subject to change. Lead-times are estimates only and we are unable to accept any liability for failure to deliver the products within the specified time.
